Epulse Eats Policies, Terms & Conditions

1. Definitions

• Platform: The Epulse Eats website, mobile applications, and other digital services.
• User, You, Your: Any person who accesses or uses the Platform, including customers, restaurant partners, and delivery personnel.
• Restaurant Partner: Any restaurant, cafe, or food vendor listed on the Platform that provides meals and food items for order.
• Order: A request by a User to purchase food and/or beverages from a Restaurant Partner via the Platform.

2. Use of the Platform

You agree to use the Epulse Eats Platform only for lawful purposes and in a way that does not infringe on the rights of others or restrict their use and enjoyment of the Platform. Prohibited behavior includes harassing, causing distress or inconvenience to any other user, transmitting obscene or offensive content, or disrupting the normal flow of the Platform.

3. Ordering and Payments

All prices for meals and delivery fees are displayed on the Platform. You are responsible for ensuring your payment information is accurate and up-to-date. All payments are processed securely. Epulse Eats reserves the right to cancel any order for which payment cannot be verified.

4. Delivery and Order Fulfillment

Epulse Eats aims to deliver your order in a timely manner. However, delivery times are estimates and may vary due to factors outside our control, such as traffic, weather, and order volume. While we strive to ensure order accuracy, a missing or incorrect item should be reported to our customer support immediately.

5. Refund and Cancellation Policy

Cancellations may be possible before the restaurant begins preparing the food. Once preparation has started, the order cannot be canceled or refunded. Refunds for incorrect or damaged orders are handled on a case-by-case basis. Please refer to our separate Refund Policy for more details.

6. User-Generated Content

You may submit reviews, comments, and other content ("User Content") on the Platform. By submitting User Content, you grant Epulse Eats a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, modify, and publish such content.

7. Intellectual Property

All content on the Epulse Eats Platform, including text, graphics, logos, images, and software, is the property of Epulse Eats or its content suppliers and is protected by copyright and intellectual property laws.

8. Limitation of Liability

Epulse Eats will not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Platform or for any food products provided by our Restaurant Partners. We act as an intermediary service and are not directly responsible for the preparation or quality of food.

9. Indemnification

You agree to indemnify, defend, and hold harmless Epulse Eats, its affiliates, and their respective officers, directors, employees, and agents from any and all claims, liabilities, damages, and costs (including legal fees) arising from your use of the Platform or your breach of these Terms.

10. Modifications to Terms

Epulse Eats reserves the right to modify these Terms at any time. Your continued use of the Platform after such modifications will constitute your acknowledgment of the modified Terms and agreement to be bound by them.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Nigeria, without regard to its conflict of law provisions. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the courts of Nigeria.

12. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining provisions shall not in any way be affected or impaired.

13. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices or policies published by Epulse Eats on the Platform, constitute the entire agreement between you and Epulse Eats concerning your use of the Platform and supersede all prior agreements, understandings, negotiations, and discussions, whether oral or written.
